General terms and conditions of sale

Preamble

These General Terms and Conditions of Sale ("GTC") govern the contractual relationship between:

AND

Any natural person with legal capacity ("the Customer") wishing to make a purchase on atelier-theepot.nl ("the Site").

Hosting / platform: Shopify Inc., 150 Elgin Street, 8th Floor, Ottawa, Ontario K2P 1L4, Canada.

These GTC describe the conditions for ordering, payment, delivery, and returns. The Customer declares to have read and accepted them before validating their order.

Atelier Theepot may modify the GTC at any time; the applicable conditions are those in force on the date of the order.

Article 1 – Products

1.1. The Products sold by Atelier Theepot are those displayed on the Site, offered within the limits of available stock. Products: physical items (teapots, accessories, etc.).

1.2. Characteristics (descriptions, photos, dimensions) are provided with the utmost care; minor deviations may occur.

Article 2 – Prices

2.1. Prices in euros (€) as stated on the Site.

2.2. Atelier Theepot may change prices; the applicable price is that in force at the time of order validation.

2.3. Unless otherwise stated (Shipping Policy), standard delivery within the Netherlands is free.

Article 3 – Order and Formation of the Contract

3.1. Steps: shopping cart → identification/address → delivery method → payment → acceptance of GTC → validation.

3.2. The contract is formed when the order is validated and payment is confirmed.

3.3. A confirmation email will be sent (products, price, quantities, address, etc.).

3.4. Atelier Theepot may refuse/cancel an order (previous dispute, suspicion of fraud, anomaly, unavailability). The Customer will be informed and, if applicable, refunded.

Article 4 – Payment

4.1. Payment due upon order.

4.2. Accepted methods: card (Visa/Mastercard), PayPal, Klarna, Google Pay.

4.3. The Customer guarantees to have the necessary authorisations to use the chosen payment method.

4.4. Payments are secured via Shopify/PSP; Atelier Theepot does not store full card details. Data is encrypted via TLS/SSL.

Article 5 – Delivery

5.1. Detailed conditions in the Shipping Policy.

5.2. Delivery exclusively in the Netherlands, to the address provided by the Customer.

5.3. Times (indicative): processing 1–2 business days; delivery after dispatch 5–7 business days; total estimated 6–9 business days.

5.4. Transfer of risk: upon taking possession by the Customer (or a third party designated by them).

5.5. Transfer of ownership: after full payment.

Article 6 – Right of Withdrawal / Damaged Products

6.1. Withdrawal: 14 calendar days from receipt, without reason or penalty.

6.2. Exercise: send notification to contact@atelier-theepot.nl (or by post) – see the standard form below.

6.3. Damaged/non-conforming: follow the Shipping Policy and Refund Policy.

6.4. Returns: within 14 days of notification, unused and undamaged products in their original packaging. Returns are accepted only after prior request; the Customer will receive a return label and instructions by email.

6.5. Refund: via the same payment method, within 10 business days of receipt/inspection; initial shipping costs will be refunded (excluding any surcharge for express delivery).

6.6. Exceptions: personalised products; sealed products opened for hygiene reasons; products inseparably mixed with other goods.

Article 7 – Legal Guarantees

In accordance with consumer law and applicable EU directives:

  • Legal guarantee of conformity: 2 years from delivery; defect presumed to exist if it appears within 24 months (new goods). Repair/replacement or, failing that, price reduction or termination.
  • Guarantee against hidden defects: 2 years from discovery of the defect; choice between termination of the sale or price reduction.

These guarantees apply independently of any commercial guarantee.

Article 8 – Intellectual Property

The Site content is protected. Any reproduction is prohibited without prior authorisation.

Article 10 – Force Majeure

Neither party (Customer or Atelier Theepot) shall be held liable in case of force majeure as defined by Dutch law and applicable EU rules.

Article 11 – Mediation

In case of a dispute, the Customer may, before any legal action, refer the matter to a competent consumer mediator or the European online dispute resolution platform (ODR).

Article 12 – Applicable Law / Competent Court

Dutch law. Disputes will be submitted to the competent court in accordance with the mandatory rules of consumer law (in particular, the court of the consumer's place of residence within the EU).

Article 13 – Proof

The electronic records of Atelier Theepot serve as proof (orders, payments, communications).

Article 14 – Miscellaneous Provisions

Partial nullity: the invalidity of a provision does not affect the other provisions. No waiver: failure to exercise a right does not imply waiver. Transferability: possible within the limits of the law.
